This Warranty is in compliance with LevelUP (we/us or our personnel) and the person/organization/entity defined in the Sales Terms and Conditions (you or your), where both are defined as Parties and one of them is defined as a Party. This Warranty is in reference to the Sales Terms and Conditions and forms a part of it.

LevelUP offers this Warranty against Defects along with your LevelUP Sauna Blanket when you purchase it.

  1. Your Rights Per Law
  • The advantages provided to you in accordance with this Warranty are additional to, but not limited to, or reducing, your rights and remedies regarding your LevelUP Infrared Sauna Blanket, under the Federal Trade Commission Act (FTC) with respect to Competition and Consumer Protection.

Mandatory wording: It should be noted that all our products come with guarantees that cannot be excluded as per the Federal Trade Commission (FTC). You will be allowed to have a refund when there is a major failure and the compensation regarding any other type of logically significant loss or damage. You will also be allowed to have the products repaired or replaced when the goods fail in terms of acceptable quality and the failure does not amount to an extreme failure.

 Warranty Period:

  1. According to the terms of this Warranty, and without infringing your statutory rights, your privileges as per this Warranty will begin from the day when your LevelUP Sauna has been dispatched in accordance with the Sales Terms and Conditions. These will be in effect for a period of 12 months, which is the so-called Warranty Period for our LevelUP Sauna Blanket.
  1. This Warranty refers to the Warranty period only, for which we will offer a refund, replacement, repair, or exchange. Your rights as per the FTC may vary when compared to this Warranty Period.

 Our actions to honor this Warranty:

  1. With respect to this Warranty (which includes you making valid claims) and without restricting your statutory rights, we will try our best to resolve issues related to any defects in your LevelUP Sauna Blanket when it is within the Warranty Period, while not requiring you to pay any sort of costs.
  1. While having full discretion, we are allowed to do any of the following:
  • Repair the LevelUP Sauna Blanket with the help of new parts or used parts that are almost similar to new parts in terms of performance and reliability.
  • Replace the handheld controller for LevelUP Sauna Blanket.
  • Replace the LevelUP Sauna Blanket with any other LevelUP Sauna Blanket of the same model, or if you agree, we will replace it with a product of the same functionality. Else, we will provide a product formed with new and/or used parts that are similar to a new product in performance as well as reliability.
  • Exchange the LevelUP Sauna Blanket for a new product, which is permitted by the law to the maximum extent, and it will be considered your total and exclusive solution regarding the Defect in your product. However, this does not mean that we try to limit your statutory rights according to consumer protection laws.
  1. If any of the parts, materials, or features used to take care of any repair or replacement regarding the abovementioned clauses are not available or are no longer produced by the company, or if your model of the LevelUP Sauna Blanket is no longer in production, then we will make use of our best endeavors to use similar parts, features, materials or model.

In what cases does this Warranty apply and in which cases it doesn’t:

  1. Until the Warranty period ends, your LevelUP Sauna Blanket is warranted by us in accordance with the terms of Warranty.

 

  1. Given below are some circumstances where we will not be held responsible to you as per this Warranty. However, this does not mean that we try to restrict your statutory rights according to consumer law.
  1. As permitted by the law to the maximum extent, this Warranty will not cover and we will not be having any responsibility for any sort of Liability, and you will waive and release us from any liability according to this Warranty in the following cases.
  • Any particular act or omission, misuse, accident, negligence, or abuse of the product by your or any third party that is not in collaboration with us.
  • Failure of following the specific set of instructions or guidelines on how to use the LevelUP Sauna Blanket. These instructions or guidelines can either be provided to us from us or the manufacturer and these can be provided in the form of a manual or brochure, or any other means, and also include the details regarding the right type of environment for using your LevelUP Sauna Blanket.
  • Using your LevelUP Sauna Blanket in any other way than the usage process that has been specified by us or the manufacturer of LevelUP Sauna Blanket.
  • Continuous usage of your LevelUP Sauna Blanket after a defect has been detected or would seem apparent to a logically sensible person, especially because such type of usage is not recommended.
  • If you fail to let us know about the Defect related to your LevelUP Sauna Blanket within 30 days of purchase after getting to know about the defect or should have reasonably become aware of the Defect.
  • Reasonable wear and tear of your LevelUP Sauna Blanket.
  • Cosmetic damage, which includes scratches, dents, and broken plastic on ports/cords/controllers but not limited to these. However, any failure that has been caused because of Defect in the materials or workmanship would not be included under these.
  • Act of God or any event related to force majeure, which include war, invasion, riot, terrorist acts, earthquake, contamination, fire, flood, and other natural disasters but are not limited to these. This also includes any event or situation which is beyond the reasonable control of us or the manufacturer.
  • Repair, Replacement, Maintenance, or compromise of the LevelUP Sauna Blanket by you or any other person when it is not us or the manufacturer.
  1. As permitted by the law up to the maximum extent, this Warranty will be nullified and we will not be held responsible for any Liability, and you waive and release us from any Liability according to this Warranty when any of the work or services offered by us are modified, tampered with or otherwise compromised by you or any other person other than us or the manufacturer, without our prior approval in writing.
  1. As permitted by the law up to the maximum extent, this Warranty will be nullified and we will not be held responsible for any Liability, and you waive and release us from any Liability when there are any delays (which includes costs resulting because of delays) while providing any work or services under this Warranty (including repairs), or in the assessment of claim made by you as per this Warranty or in relation with this.
  1. All our products, which include LevelUP Sauna Blanket, are designed while being intended for home use. It should be taken into careful consideration that they are not intended for commercial purposes such as commercial gyms, commercial spas, wellness centers, chiropractor offices, physician offices, medical facilities, police departments, fire departments, churches, government agencies, hotels, apartment communities, cruise ships, universities, schools, and other commercial places but are not limited to these. When you use our product for commercial purposes, the Warranty will become nullified, we will not be held responsible for any Liability, and you waive and release us from any Liability according to this Warranty or otherwise.

How to make a valid Warranty claim

 

  1. In order to claim the benefit of this Warranty, you should be able to:
  • Get in touch with us through our email at support@levelupsauna.com as soon as you detect the Defect, and in any such event, you should notify within 30 days of detection of the Defect.
  • You should provide us with any other details or evidence as necessitated by us to make an assessment of your claim, and this includes photographs, description of the defect.
  • You should let us know about when you became aware of the Defect, regarding your LevelUP Sauna Blanket.
  • You should also provide us with the proof of purchase of your LevelUP Sauna Blanket from us when it is requested by us.
  1. If we establish that you have a valid claim in accordance with this Warranty, then we will let you know about our determination regarding whether your claim is valid according to this Warranty according to the Warranty Terms. We will send the prepaid postal stamps and instructions to you describing how you can properly pack and send your LevelUP Sauna Blanket to us. All the necessary instructions on how to send us your LevelUP Sauna Blanket through email. If we decide to repair or exchange your LevelUP Sauna Blanket, then we will send it after repair or exchange/replace it. Additionally, we will pay for the shipping costs to and from your address determining that you have followed the instructions related to packing and shipping the LevelUP Sauna Blanket.
  1. We have all the necessary rights to modify the method by which we offer service according to this Warranty. The service of the products will depend on the area from where you have requested service. The options for service, parts, availability and response time may actually differ depending on the state/locality. In some cases, you would be held responsible for the charges related to shipping and handling the products, if LevelUP Sauna Blanket is not serviced in your state/locality. If you are seeking to find service options from a state that is not the original state of purchase, then you are agreeing that you are responsible for all the import and export laws that are applicable, along with the costs related to it such as customs duties, VAT, and other types of taxes/charges. However, when there are service options available for your state, the LevelUP will take care of all the costs related to the repair or replacement of the LevelUP Sauna Blanket regarding the products and parts.
  1. As permitted by the law to the maximum extent, any decision we make will be the final and binding decision.

General

  1. Sales Terms and Conditions apply: This Warranty is in compliance with the Sales Terms and Conditions and in a situation of any inconsistency or vagueness between the Warranty and the Sales Terms and Conditions, and in such cases the Sales Terms and Conditions are applicable.
  1. Limitation of Liability: As permitted by the law to the maximum extent, us being responsible for any Liability according to this Warranty is limited and/or excluded with respect to any sort of limitation or exclusion as per the Sales Terms and Conditions.
  1. Consequential Loss: Regardless of anything to the contrary, as permitted by the law to the maximum extent, we should not be held responsible for consequential loss.
  1. Jurisdiction and applicable law: This Warranty is governed by the laws present within the United States of America, and both the parties of this Warranty should irrevocably and unconditionally submit to the jurisdiction of the courts that operate in the US.
  1. No third-party: This Warranty is specified only for you, i.e., owner of the LevelUP Sauna Blanket, and it cannot be utilized by any other person or third party.
  1. No Assignments or Transfers: This Warranty or the advantages of this warranty cannot be transferred or assigned to another person or third party.
  1. Severance: If any condition among these Terms is held to be illegal, nullified, or unenforceable, then that condition should be read down as clearly as possible for allowing it to be valid or enforceable, where that condition (or a part of that condition) is to be severed from the Terms without affecting the plausibility of the remaining part of that condition or other conditions.

Definitions:

According to this Warranty, all the capitalized terms have meanings as per the meanings given to them in the Sales Terms and Conditions, and it should be taken into consideration that

Consequential Loss refers to any type of consequential loss, indirect loss, real loss, anticipated loss of profit, loss of revenue, loss of goodwill, loss of benefit, loss of business, loss of reputation, loss of savings, loss of opportunity, loss of use, loss/corruption of data, which can be under the statute, equity, contract, tort (along with negligence), indemnity, etc.

Defect refers to any non-compliance of the LevelUP Sauna Blanket with the necessities of our Sales Terms and Conditions resulting from our default, and Defective has a similar meaning.

LevelUP Sauna Blanket refers to the products supplied by us to you regarding the Sales Terms and Conditions and consists of our branded accessories belonging in the original packaging of the LevelUP Sauna Blanket that has been provided to you.

Sales Terms and Conditions refer to our Sales Terms and Conditions that apply between the parties regarding the LevelUP Sauna Blanket.
